What is an expert witness? So personal injury has got two sides. There’s a liability aspect and then there’s a damages aspect of a case. In some jurisdictions and some venues, you will try a case with both liability and damages together, and in others, you must prove liability first. Which is who was the negligent party and why in order to get to damages. So when you have an expert witness, sometimes an expert witness can be damages, meaning what was injured and why, and was it causally related to the actual incident that occurred, and then there’s liability experts. These experts will help give our clients the ability to prove their case. Essentially, we have the burden of proof to prove our case. Just because somebody’s injured doesn’t mean that it was someone else’s fault. We have to show that, and through expert testimony, we’re able to do that and help our jurors figure out the facts of the case.
