How Much Is Your Car Accident Claim Worth?

It is impossible to guarantee the precise amount of compensation you may receive through a car accident lawsuit. That said, you may be eligible to recover significant damages, especially if your injuries were severe.

During your free consultation, our auto accident attorneys will review the unique circumstances of your accident and determine its full impact on your life and well-being. As we gauge the value of your case, we will consider a wide range of factors, including how your injuries are likely to affect you in the weeks, months, and years ahead.

Economic vs. Non-Economic Damages

Economic damages are compensation for monetary losses, such as past and future lost wages, past and future medical expenses, and property damage. By contrast, non-economic damages compensate for intangible losses, including:

  • Physical pain and suffering
  • Loss of enjoyment of life
  • Scarring and disfigurement
  • Disability
  • Psychological trauma

New York’s Fault Laws

New York is a no-fault insurance state, which means drivers in the state must purchase personal injury protection (PIP) insurance. After a New York car accident, you must first seek compensation through your PIP policy, regardless of who was at fault for the accident.

PIP covers necessary medical expenses and up to 80 percent of lost wages (maximum of $2,000 monthly for up to three years). It also covers incidental expenses, such as housekeeping and transportation to medical appointments, for up to a year. If your loved one was killed in a car accident, PIP also provides certain death benefits payable to the estate of the decedent.

Importantly, no-fault PIP insurance does not cover non-economic damages. To recover non-economic damages after a car accident, you must file a lawsuit against the at-fault driver or a liable third party. In New York, you can step out of the no-fault system if you suffer either (1) a “serious injury” or (2) a “basic economic loss” exceeding $50,000.

Severity of Injuries

The NYPD Traffic Safety Forum reports that 3,090 collisions happened in the Bronx in 2023, which injured 1,186 people and killed 10. Section 5104 of the New York Insurance Code allows you to file a claim against the at-fault driver’s insurance policy if suffer a “serious injury,” defined as:

  • Death
  • Dismemberment
  • Significant disfigurement
  • A broken bone
  • Miscarriage
  • Permanent organ damage
  • Permanent loss or significant limitation of a bodily function
  • An injury that prevents you from performing usual activities for 90 days or more

If you suffer a serious injury, you can then file a claim against the at-fault driver’s auto liability policy, as well as a personal injury lawsuit. New York drivers are required to carry the following minimum auto liability coverage:

  • $10,000 for property damage for a single accident
  • $25,000 for bodily injury per person involved in an accident ($50,000 if they are killed)
  • $50,000 for bodily injury for two or more people in an accident ($100,000 if they are killed)

If the at-fault driver’s coverage is insufficient to cover your damages, you may be able to recover additional damages through your own underinsured motorist policy or by filing a lawsuit against liable third parties. Our skilled car accident attorneys will identify all liable parties in your case to maximize your compensation.

What is the Most Common Cause of Car Accidents in the Bronx?

The most common cause of car accidents in the Bronx is distracted driving. In February of 2024 alone, distracted driving caused 264 collisions. Common distractions include talking on the phone, texting, eating, adjusting the radio, and talking to passengers.

Any activity that takes a driver’s focus away from the road should be avoided. Other common causes of car accidents in the Bronx include:

  • Following too closely
  • Speeding
  • Failing to yield
  • Unsafe lane changing
  • Turning improperly
  • Passing too closely
  • Unsafe backing
  • Drinking and driving
  • Aggressive driving
  • Disobeying traffic signals

How Long Do I Have to File an Injury Claim After an Accident in the Bronx?

The New York personal injury statute of limitations generally gives three years from the date of an accident to file a personal injury lawsuit. However, if your loved one was killed in a car accident, their estate representative normally has two years from the date of death to file a wrongful death claim

While two or three years may seem like plenty of time, you shouldn’t wait to have your case evaluated by an experienced personal injury lawyer. Crucial evidence can quickly disappear soon after an accident. Further, waiting to take legal action can give the at-fault party and their insurers a chance to question the seriousness of your injuries.

Though certain exceptions may extend the time you have to file your claim, you should not rely on them before consulting with an attorney to see if they apply to your case. Remember, failure to file before the correct deadline passes will result in your case being dismissed in court. Not only will this destroy your right to seek compensation in court, it will also destroy your bargaining power in out-of-court settlement negotiations.

The Car Accident Lawsuit Process

Car accident claims are complex. Don’t worry. Once you choose us as your designated hitters, we will hit the ground running. While you focus on recovering from your injuries, we will focus on securing the full and fair compensation you are entitled to by law.

Case Investigation

We will conduct a thorough investigation of the accident, gather all available evidence, and review your medical records to determine the compensation you are owed and the best legal strategy for your case.

Insurance Claim

We will file a no-fault claim with your insurance company, as well as an at-fault claim against all liable parties identified during our independent investigation into the cause of your car accident.

In addition to insurance claims, we will also file a lawsuit on your behalf. This step requires investigating the law, preparing case documents, and complying with all deadlines and procedural requirements. You can count on us to handle your case with the utmost care and attention it deserves.

“Discovery” refers to the exchange of information between parties in a lawsuit. We will request documents from the opposing parties to strengthen your claim. We will also provide documents to the opposing party as required and push back against unreasonable requests.

A deposition is an out-of-court meeting with opposing counsel during which you may be required to testify under oath. Cases are often resolved based on testimony given in deposition. Our legal team will prepare you for your deposition and stand by your side throughout the process.

Settlement Negotiations

We will aggressively negotiate a settlement with the liable parties and their insurance companies. Often, insurers make lowball offers early on, hoping to pay you less than you deserve. Remember, settlement negotiations require patience, and a quick settlement is not always a good settlement.

If a fair settlement cannot be reached, our car accident attorneys have the skills and resources to take the battle to court. We are seasoned trial lawyers dedicated to creating a new perception of legal dominance. Should a trial become necessary, we are ready to provide the high-quality legal advocacy you deserve.

How Long Do Car Accident Claims Take to Settle?

Most car accident cases settle within a few months, but your case may take longer if your injuries are severe or your case goes to trial. We will pursue all available sources of compensation. While you wait for a full resolution of your case, you should be able to recover part of your compensation through a no-fault PIP insurance claim.

How To Get Your Police Accident Report in the Bronx

You can request a copy of the police report through the NYPD Collision Report Retrieval Portal. You can also request a copy through the New York Department of Motor Vehicles. If you have not done so already, we will obtain a copy of the crash report for your case file.
