When dealing with road defects and an accident occurring, we have to figure out whether or not and in what capacity that road defect caused or created the accident. So there can be a cumulative effect as to whether parties were negligent in seeing it, whether it was protected or not, was it reasonably protected or not, and whether or not and if it wasn’t, then did it highly impact the causation of the accident. So there’s so many factors into looking at that. And then how long was that defect there and notice issues as far as should they have properly barricaded it off or should they have repaired it in time and was it foreseeable whether or not this particular road defect could have led to the accident that did take place.
